Procedure for Employees

Perhaps your employer has suggested mediation. Perhaps the company doctor has recommended mediation. Or perhaps you yourself have indicated that you would like to speak with an independent mediator.

Bij Van Opstal & Partners vinden wij het belangrijk dat u vooraf precies weet wat u kunt verwachten. Daarom leggen wij het proces rustig uit en nemen wij de tijd om uw vragen te beantwoorden. U hoeft niet direct met oplossingen te komen. Mediation begint met het creëren van een veilige omgeving waarin beide partijen hun verhaal kunnen vertellen. Dat sluit aan bij de uitgangspunten van de MfN: vrijwilligheid, transparantie en eigen regie van partijen. 

Our Approach


Step 1 – Our case manager will contact you

Voordat de mediation start, neemt één van onze casemanagers contact met u op. Tijdens dit gesprek leggen wij het volgende uit:

  • What mediation entails; 
  • How the process works; 
  • What to Expect; 
  • Any questions you may already have. 

You will then receive all the information you need to be well-prepared for the mediation.


Step 2 – Meeting with the Mediator

We will connect you with an experienced MfN-registered mediator who specializes in labor mediation.

The mediator will contact you to schedule an initial meeting.


Step 3 – One-on-one meeting

Each party is first given the opportunity to present its case separately.

The purpose of this conversation is to:

  • Encouraging people to discuss any concerns they may have;
  • Let's get to know each other; 
  • Answer questions; 
  • To discuss expectations; 

Step 4 – The Joint Discussion

During the joint sessions, the mediator guides the process. You can always expect the following from our mediators:

  • The mediator does not take sides.
  • The mediator does not make decisions.
  • The mediator helps both parties resume their dialogue.
  • First, let's look at what happened.
  • After that, we'll focus primarily on the future.

Step 5 – Working Together to Find a Solution

Ieder mediationtraject is anders en de uitkomst staat nooit vast voor het traject begint. Soms herstellen werkgever en werknemer de samenwerking. Soms worden afspraken gemaakt over re-integratie. En, soms besluiten partijen gezamenlijk dat beëindiging van het dienstverband de beste oplossing is.

Whatever the outcome may be, you and the other party will decide together what arrangements to make. This means you remain in control of the situation at all times.


Step 6 – Documenting the Agreements

When you reach agreements together, they are carefully documented. That way, everyone knows where they stand.

Frequently Asked Questions from Employees

Do I have to agree to all the terms?

No. The mediation process is designed to help you reach workable agreements that are acceptable to both parties. You can indicate at any time that you do not agree with certain arrangements. Of course, cooperation with the process is a requirement if you wish to reach agreements together.

Can I stop the mediation process whenever I want?

Yes. You can stop the mediation at any point in the process. Mediation is always voluntary and only works if all parties are willing to talk to each other.

Can I bring someone with me to the mediation session?

Yes, but only if both parties agree to it.

What if I get sick during the mediation process?

When mediation takes place while you are on sick leave, it is often done on the advice of the company physician. If you have any doubts about whether you are medically able to participate, please discuss this with your company physician. In certain situations, you can also request a second opinion or an expert assessment.
