Exit-Mediation in labor disputes.
Sometimes saying goodbye is the best solution. With exit mediation, we guide that carefully, quickly and legally correct.
When it is no longer realistic to continue together, exit mediation offers a dignified and solution-oriented alternative to legal proceedings. At Van Opstal & Partners, we have been assisting employers and employees since 1995 in carefully concluding an employment relationship, with an eye for interests, emotions and workable agreements.
What is exit -mediation?
Exit mediation is a form of employment mediation in which the goal is to terminate employment by mutual agreement. Under the guidance of a neutral MfN registered mediator, agreements are made about the terms of departure, such as the termination date, compensation, notice period and communication.
The result is recorded in a settlement agreement (VSO). We ensure that this process is smooth, respectful and legally tenable.
Why choose exit mediation?
-
Less cost and time than legal proceedings
-
More direction and influence for both parties
-
Space for recognition, processing and completion
-
Respectful goodbyes - employees leave as ambassadors
-
Direct capture of agreements in the VSO
Our approach: three clear steps
1. Preparation & Review
We start with a review of the conflict and make space for the emotions and interests at play. This helps to keep the conversation open and realistic.
2. Determine direction
Is proceeding together not feasible? Then we help parties map out the terms of departure. Consider: notice period, work release, compensation, legal fees, vacation days, communication and reference.
3. Negotiation & Conclusion
The mediator tightly controls the process and helps parties (together with their advisors) reach workable agreements. These are recorded in a settlement agreement. If necessary, we schedule a session (physical or online) to come to a conclusion.
Only with MfN-registered mediators
All mediators at Van Opstal & Partners are certified through the MfN register and have extensive experience in labor conflicts and exit processes. We combine legal knowledge with a feel for relationships and human behavior.
When is exit mediation appropriate?
-
In case of prolonged tensions or disrupted cooperation
-
When reintegration gets stuck
-
In the case of functional conflicts with no prospect of recovery
-
If both parties want to quit, but the terms have yet to be determined
